Please read these Terms and Conditions carefully. By registering for an account or by accessing or using the services, you agree to be bound by these Terms and Conditions and all terms incorporated by reference. If you do not agree to all of these Terms and Conditions, do not access or use the services.
Routesurfing EU OÜ (from now and on knows as “Routesurfing”) has developed a carpooling platform accessible on a website at the address routesurfing.org and designed to put drivers travelling to a given destination in contact with travellers going in the same direction, in order to enable them to share the Trip (hereinafter referred to as the “Platform”).
These terms and conditions have the purpose of governing access to and the terms and conditions of the Platform. Please read them carefully. You understand and recognise that Routesurfing is not party to any agreement, contract or contractual relations, of any nature, entered into between the Members of its Platform.
We reserve the right to make changes or modifications to these Terms and Conditions, or any policy or guideline of our Services, at any time and in our sole discretion.
Routesurfing may modify these Terms and Conditions in order to adapt to its technological and commercial environment, and to comply with the legislation in force.
If Routesurfing makes changes to these Terms and Conditions, we will provide notice of such changes, including by revising the date at the top of these Terms and Conditions. Your continued use of our Services following the posting of changes or modifications will constitute your acceptance of such changes or modifications. Accordingly, you should frequently review these Terms and Conditions and applicable policies and guidelines to understand the Terms and Conditions that apply to your use of the Services.
The Platform is in beta stage, which is why it may contain errors, failures or inconsistencies of information with respect to reality. You are solely responsible of the use of the Platform being Routesurfing free of any legal responsibility for the failures that occurred.
“Trip Offer” means an advertisement about a Trip posted on the Platform by a Driver;
“Routesurfing” has the meaning mentioned in Article 1 above;
“Account” means the account that must be created in order to become a Member and access to the services offered by the Platform;
“Third-party Social Media” has the meaning given to it in Article 3.2 below;
“Driver” means the User using the Platform, that offer to transport another individual in a Trip and at a time defined by the Driver previously;
“Booking Confirmation” has the meaning given to it in Article 5.2 below;
“User Content” has the meaning given to it in Article 12.2 below;
“User” means any individual having created an Account on the Platform;
“Traveller” means the User having accepted the offer to be transported by the Driver or, where applicable, the person on whose behalf a User has booked a Seat;
“Seat” means the seat booked by a Traveller in the Driver’s vehicle;
“Platform” has the meaning given to it in Article 1 above;
“Booking” has the meaning given to it in Article 5.2 below;
"Services" means all the services offered by Routesurfing through the Platform;
“Website” means the website accessible at the address routesurfing.org;
"Trip" means the subject of an Offered Trip posted by a Driver on the Platform by which the Driver agrees to share a Trip with Travellers, Platform Users;
"Trip Offered with Automatic Approval" has the meaning given to it in Article 5.2 below;
"Trip Offered with Manual Approval" has the meaning given to it in Article 5.2 below;
The Platform must be only used by individuals aged 18 or over. Registration on the platform by a minor is strictly prohibited. In accessing, using or registering on the Platform, you represent and warrant that you are aged 18 or over.
To register on the Platform, you must have read and accepted these Terms and Conditions and the Privacy Policy.
The Platform enables Users to post and view Trips Offered and to interact with each other to book a Seat. You cannot post a Trip Offer or book a Seat without having first created an Account and become a User.
To create your Account you can use either of the two methods below:
(a) by email address, completing all mandatory fields on the registration form;
(b) or logging in to your Third-party Social Media account via our Platform.
When creating your Account, regardless of the method chosen, you further agree to (a) provide accurate, truthful, current and complete information; (b) maintain and promptly update your account information upon any changes; (c) maintain the security of your account by protecting your password and restricting access to your account; (d) promptly notify Routesurfing if you discover or otherwise suspect any security breaches related to the Services; and (e) take responsibility for all activities that occur under your account and accept all risks of any authorized or unauthorized access.
In the case of registration by email, you agree to keep secret the password chosen upon creating your Account and not to communicate it to anybody. If you lose or disclose your password, you undertake to inform Routesurfing immediately. You alone are responsible for the use of your Account by third parties, unless you have expressly notified Routesurfing of the loss, the fraudulent use by a third party, or the disclosure of your password to a third party.
In using Third-party Social Media account, you understand that Routesurfing will have access to, will publish on the Platform, and will keep certain information from your Account. You agree not to create or use, under your own identity or that of a third party, Accounts other than that initially created.
Our Services provide a platform for Users to connect one another, arrange Trips and travel together and communicate with one another. Routesurfing is not a party to, has no involvement or interest in, makes no representations or warranties as to, and has no responsibility or liability with respect to any communications, transactions, interactions, disputes or any relations whatsoever between you and any other User, person or organization. You are solely responsible for your interactions with other Users of our Services. We reserve the right, but have no obligation, to monitor interactions between you and other Users of our Services.
Remember, the Routesurfing Services are just a platform that enable you to communicate and interact with other people around the world. We cannot be responsible for the interactions that you have with other Routesurfing Users, so please use good judgment and keep safety in mind when you use our Services.
We cannot and do not confirm each user’s identity. Although we provide tools intended to assist with identity verification, such as our email address verification tool, you are solely responsible for determining the identity and suitability of others with whom you may interact through our Services. Routesurfing does not represent or warrant that our tools are sufficient to determine whether it is appropriate for you to interact with another User. Further, we do not endorse any persons who use or register for our Services. We do not investigate or verify any User’s reputation, conduct, morality, criminal background, or any information users may submit to the Services. We encourage you to take precautions when interacting with other Users, particularly when meeting a stranger in person for the first time.
Because our Services are merely a platform, in the event that you have a dispute with one or more Users, to the fullest extent permitted by applicable law you release Routesurfing from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
As User, and providing you fulfil the conditions below, you can create and post Trips on the Platform by entering information about the Trip you intend to make (dates/times and departure points and arrival, number of seats offered, options available, etc.).
You are only authorised to post a Trip if you fulfil all the following conditions:
(a) you hold a valid driving licence;
(b) you only post Trip Offers with vehicles you own or use with the express permission of the owner, and in all cases that you are authorised to use for the purposes of carpooling;
(c) you are and remain the main driver of the vehicle subject of the Trip;
(d) the vehicle has valid third party insurance;
(e) you have no contraindication or medical incapacity for driving;
(f) the vehicle you intend to use for the Trip is a touring car with 4 wheels and a maximum of 7 seats;
(g) you do not intend posting another Trip for the same Trip on the Platform;
(h) you do not offer more Seats than the number available in your vehicle;
(i) all Seats offered have a seatbelt, even if the vehicle is approved with seats having no seatbelt;
(j) to use a vehicle in good working order and which complies with the applicable legal provisions and customs, notably with an up-to-date vehicle inspection.
You recognise that you are solely responsible for the content of the Trip you post on the Platform.
Consequently, you represent and warrant the accuracy and truthfulness of all information contained in your Trip Offer, and you undertake to fulfil the Trip under the conditions described in your Trip Offer.
Providing your Trip Offer complies with the Terms and Conditions, it will be posted on the Platform and therefore visible to Users conducting a search on the Platform. Routesurfing reserves the right, at its sole discretion and without notice, to not post or to remove, at any time, any Trip Offer that does not comply with the Terms and Conditions or that it considers as damaging to its image, that of the Platform, or that of the Services.
You recognise and accept that the criteria taken into account in the classification and the order of display of your Trips Offered among the other Trips Offer are at the sole discretion of Routesurfing.
Routesurfing has set up a system for booking Seats online (“Booking”) for Trip Offers on the Platform.
When a Traveller is interested in a Trip Offer, he may make an online Booking request. This Booking request is either (a) accepted automatically (“Trip Offered with Automatic Approval"”) if the Driver chose this option when posting his Trip Offer, or (b) accepted manually by the Driver (“Trip Offered with Manual Approval”), in which case the Driver receives a notification. After validation of the Booking request by the Driver, where applicable, the Traveller receives a Booking Confirmation (the “Booking Confirmation”).
If you are a Driver and have chosen to handle manually the Bookings requests when posting your Trip Offer, you are required to respond to any Booking request.
At the time of the Booking Confirmation, Routesurfing will send an email notification to the Traveller with more details about the Trip: vehicle information, reservation code, etc.
From now and on, Driver and Traveller are then solely responsible for executing the contract binding each other.
There is a message system implemented in the Platform to allow the communication between each other.
Any use of the Services, in the capacity of Traveller or Driver, relates to a specific name. The Driver and the Traveller must correspond to the identity communicated to Routesurfing and the other Users participating in the Trip.
However, Routesurfing allows its Users to book one or more Seats on behalf of a third party. In this case, you undertake to accurately indicate to the Driver, at the time of the Booking the forenames and age of the person on whose behalf you are reserving a Seat. It is strictly prohibited to book a Seat for a minor under the age of 13 travelling alone. In the case where you are reserving a seat for a minor over the age of 13 travelling alone, you undertake to request the prior agreement of the Driver and to provide him with duly completed and signed permission of his/her legal representatives.
In addition, the Platform is intended for the booking of Seats for individuals. It is forbidden to book a Seat for transporting any object, package, animal traveling alone or material items whatsoever.
Furthermore, it is prohibited to publish a Trip Offer for a Driver other than you.
Routesurfing encourages you to leave a review about a Driver (if you are a Traveller) or about a Traveller (if you are a Driver) with whom you have shared a Trip or with whom you were supposed to share a Trip. However, you are not permitted to leave a review about another Traveller if you were a Traveller, or about a User with whom you have not travelled or with whom you were not supposed to travel.
Your review, and the review left by another User about you, are only visible and published on the Platform after both Users (driver and traveller) have reviewed each other. Those reviews must be done within the 10-days starting on the next day when the Trip took place.
Each User will see in its profile, only the reviews received.
You recognise and accept that Routesurfing reserves the right not to publish or to delete any review, any question, any comment or any response if the content is not appropriate.
Routesurfing reserves the right to suspend your Account in the case where the average review you have received is less than or equal to 3.
Access to and registration on the Platform, as well as searching, viewing and posting Trip Offers, and Booking Seats are free of charge. The Platform is totally free.
You agree to use the Services and the Platform only to be put into contact, on a non-business and non-commercial basis, with people wishing to share a Trip with you.
Routesurfing reserves the right to suspend your Account in the case of activity by you on the Platform which, owing to the nature of the Trips Offer, their frequency and the number of Travellers carried, entails a situation of profit for you, or for any reason suggesting to Routesurfing that you are generating a profit on the Platform.
Routesurfing is working on this point.
You recognise being solely responsible for respecting all laws, regulations and obligations applicable to your use of the Platform.
Furthermore, when using the Platform and during Trips, you undertake:
(a) not to use the Platform for professional, commercial or profit-making purposes;
(b) not to send Routesurfing (notably upon creation or updating of your Account) or the other Users any false, misleading, malicious or fraudulent information;
(c) not to speak or behave in any way or post any content on the Platform of a defamatory, injurious, obscene, pornographic, vulgar, offensive, aggressive, uncalled-for, violent, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances, or more generally contrary to the purposes of the Platform, that may infringe the rights of Routesurfing or a third party or contrary to good morals;
(d) not to infringe the rights and image of Routesurfing, notably its intellectual property rights;
(e) not to open more than one Account on the Platform and not to open an Account in the name of a third party;
(f) not to try to bypass the online booking system of the Platform, notably by trying to send another User your contact details in order to make the booking outside of the Platform, this will help to keep all Users safest;
(g) not to contact another User, notably via the Platform, for a purpose other than defining the terms of the carpooling;
(h) to comply with these Terms and Conditions and the Privacy Policy.
Furthermore, when you use the Platform as Driver, you undertake:
(a) to respect all laws, regulations and codes applicable to driving and the vehicle, notably to hold civil liability insurance valid at the time of the Trip and to be in possession of a valid driving licence;
(b) to check that your insurance covers carpooling and that your Travellers are considered as third parties in your vehicle and are therefore covered by your insurance during the whole Trip, even if cross-border;
(c) not to take any risk when driving, not to take any product that may impair your attention and your abilities to drive vigilantly and completely safely;
(d) to post Trip Offers corresponding only to Trips actually planned;
(e) to make the Trip as described in the Trip Offer (notably with regard to using or not using the motorway) and to respect the times and places agreed with the other Users (notably meeting place and drop-off point);
(f) not to take more Travellers than the number of Seats indicated in the Trip Offer;
(g) to use a vehicle in good working order and which complies with the applicable legal provisions and customs, notably with an up-to-date vehicle inspection;
(h) to communicate to Routesurfing or any Traveller who so requests your driving licence, your car registration certificate, your insurance certificate, your vehicle inspection certificate and any document demonstrating your capacity to use the vehicle as Driver on the Platform;
(i) in the case of holdup or change to the time or the Trip, to inform your Travellers without delay through the Platform message system;
(j) in the case of a cross-border Trip, to hold and keep available to the Traveller and any authority that may so request any document evidencing your identity and your right to cross the border;
(k) to wait for Travellers at the agreed meeting place for at least the flexible time specified in the Trip Offer;
(l) not to post a Trip Offer relative to a vehicle you do not own or that you are not authorised to use for the purposes of carpooling;
(m) to ensure you can be contacted by your Travellers through the Platform message system;
n) not to generate any profit via the Platform;
(o) not to have any contraindication or medical incapacity for driving;
(p) to behave appropriately and responsibly during the Trip, and in compliance with the spirit of carpooling;
(q) not to decline any Booking based on race, color, ethnicity, national origin, religion, sexual orientation, marital status, disability, physical appearance, marital status, pregnancy, special vulnerability due to their economic situation, name, place of residence, health, political opinion, age.
When you use the Platform as Traveller, you undertake:
(a) to adopt appropriate behaviour during the Trip so as not to hinder the concentration or driving of the Driver or the peace and quiet of the other Travellers;
(b) to respect the Driver’s vehicle and its cleanliness;
(c) in the case of holdup, to inform the Driver without delay through the Platform message system;
(d) to wait for the Driver at the meeting place for at least the flexible time specified in the Trip Offer;
(e) to communicate to Routesurfing, or any Driver who so asks, your identity card or any document evidencing your identity;
(f) not to carry during a Trip any item, goods, substance or animal that could hinder the driving and concentration of the Driver, or the nature, possession or carriage of which is contrary to the legal provisions in force;
(g) in the case of a cross-border Trip, to hold and keep available to the Driver and any authority that may so request any document evidencing your identity and your right to cross the border;
(h) to ensure you can be contacted by the Driver through the Platform message system, including at the meeting point.
In the event where you have made a Booking for one or more Seats on behalf of third parties, in compliance with the stipulations of Article 5.2.1 above, you guarantee respect by this third party for the stipulations of this article, and generally these Terms and Conditions. Routesurfing reserves the right to suspend your Account, limit your access to the Services, or terminate these Terms and Conditions, in the case of breach by the third party on whose behalf you have booked a Seat under these Terms and Conditions.
Routesurfing is working on this point. By now, Users registered with email address need to contact us thought our Contact Form requesting the account cancelation. Users registered with Third-party Social Media account must follow the instruction defined in each Third-party Social Media.

You can terminate your contractual relations with Routesurfing at any time, without cost and without reason. To do this, simply go to the “Close my account” section of your account page.
In the context of your use of the Platform, Routesurfing will collect and process some of your personal data. In using the Platform and registering as User, you recognize and accept the processing of your personal data by Routesurfing in compliance with the applicable law and the stipulations of the Privacy Policy.
Subject to the contents provided by its Users, Routesurfing is the sole holder of all intellectual property rights relating to the Service, the Platform, its content (notably texts, images, designs, logos, videos, sounds, data, graphics) and to the software and databases ensuring their operation.
Routesurfing grants you a non-exclusive, personal and non-transferable right to use the Platform and the Services, for your personal and private use, on a non-commercial basis and in compliance with the purposes of the Platform and the Services.
You are prohibited from any other use or exploitation of the Platform and Services, and their content, without the prior written permission of Routesurfing. Notably, you are prohibited from:
(a) reproducing, modifying, adapting, distributing, publicly representing and disseminating the Platform, the Services and the content, with the exception of that expressly authorised by Routesurfing;
(b) decompiling and reverse engineering the Platform or Services, subject to the exceptions stipulated by the texts in force;
(c) extracting or attempting to extract (notably using data mining robots or any other similar data collection tool) a substantial part of the data of the Platform.
In order to enable the provision of the Services, and in compliance with the purpose of the Platform, you grant Routesurfing a non-exclusive licence to use the content and data you provide in the context of your use of the Services (hereinafter referred to as your “User Content”). In order to enable Routesurfing to distribute via the digital network and in accordance with any communication protocol (notably internet and mobile network), and to provide the content of the Platform to the public, you authorise Routesurfing, for the whole world and throughout the duration of your contractual relations with Routesurfing, to reproduce, represent, adapt and translate your User Content as follows:
(a) you authorise Routesurfing to reproduce all or part of your User Content on any digital recording media, known or as yet unknown, and notably on any server, hard disk, memory card, or any other equivalent media, in any format and by any process, known or as yet unknown, to the extent necessary to any operation of storage, backup, transmission or download linked to the operation of the Platform and the provision of the Service;
(b) you authorise Routesurfing to adapt and translate your User Content, and to reproduce these adaptations on any digital media, current or future, stipulated in point (a) above, with the aim of providing the Services, notably in different languages. This right notably includes the option to make modifications to the formatting of your User Content, with respect for your moral right, for the purposes of respecting the graphics charter of the Platform and/or making it technically compatible with a view to its publication via the Platform.
The Platform constitutes an online networking platform on which the Users can create and post Trip Offers for Trips for the purposes of carpooling. These Trip Offers can notably be viewed by the other Users to find out the terms of the Trip, and to directly book a Seat in the vehicle in question with the User having posted the Trip Offer on the Platform.
In using the Platform and in accepting these Terms and Conditions, you recognise that Routesurfing is not party to any agreement entered into between you and the other Users with a view to sharing the costs relating to a Trip.
Routesurfing has no control over the behaviour of its Users of the Platform. It does not own, exploit, supply or manage the vehicles subject of the Trip Offers, and it does not offer any Trips on the Platform
You recognise and accept that Routesurfing does not control the validity, truthfulness or legality of the Trip Offers and Seats. In its capacity of carpooling intermediary, Routesurfing does not provide any transport service and does not act in the capacity of carrier; the role of Routesurfing is limited to facilitating access to the Platform.
The Users (Drivers or Travellers) act under their sole and full responsibility.
In its capacity of intermediary, Routesurfing cannot be held liable for the effective occurrence of a Trip, and notably owing to:
(a) erroneous information communicated by the Driver in his Trip Offer, or by any other means, with regard to the Trip and its terms;
(b) cancellation or modification of a Trip by a User;
(c) the behaviour of its Users during, before or after the Trip.
Routesurfing shall try as far as possible to maintain the Platform accessible 7 days a week and 24 hours a day. Nevertheless, access to the Platform may be temporarily suspended, without notice, owing to technical maintenance, migration or update operations, or owing to outages or constraints linked to the operation of the network.
Furthermore, Routesurfing reserves the right to modify or suspend all or part of access to the Platform or its functionalities, at its sole discretion, temporarily or permanently.
These Terms and Conditions and the documents integrated by reference express the entire agreement between you and Routesurfing relative to your use of the Services. Any other document, notably any mention on the Platform (FAQ, etc.), is for guideline purposes only.
Routesurfing may modify these Terms and Conditions in order to adapt to its technological and commercial environment, and to comply with the legislation in force. Any modification to these Terms and Conditions will be published on the Platform with mention of the date of effect, and you will be notified by Routesurfing before it takes effect.
The platform is published by Routesurfing EU OÜ, registered with the Companies Register of Estonia under number 16855436, with its registered office at Harju maakond, Tallinn, Kesklinna linnaosa, Ahtri tn 12, 15551, Estonia, represented by its CEO Matias Carrasco.
The Platform is hosted on AWS servers.
